Terms of Service
Written to be read. You buy a licence once, you keep it, and you can use it on the machines you perform on. The rest is detail.
Who you are dealing with
Performance Percussion is a Nashville, Tennessee business making software for people who perform live. "We" and "us" mean Performance Percussion. "You" means the person or organisation using the software.
What you are buying
A perpetual licence to use the software. One payment, no subscription, no renewal, no expiry. The version you buy keeps working for as long as it runs on your hardware, whatever we do later.
- Personal licence. One person, on the machines that person performs and rehearses on. Your laptop and your backup laptop are the same licence, not two.
- Site licence. One school, programme, or organisation, on the machines belonging to it, used by its staff and students. Sold per site, not per seat.
You may not resell, rent, sublicence, or redistribute the software or your licence key, or share the key publicly. A key posted where anyone can grab it may be deactivated.
Updates
Updates within a version are free. If we ever release a paid major upgrade, we will say so plainly and you will keep the version you bought — it will not stop working and it will not start nagging you.
Trials
Trial versions are the full app with playback or session limits, so you can evaluate it properly on your own gear before paying. Working around those limits, rather than buying, is a breach of these terms.
Payment
Direct purchases are handled by Paddle, who act as the merchant of record and reseller. Your receipt comes from Paddle, they handle sales tax and VAT, and their terms apply to the transaction itself. Purchases made through Apple's App Store are sold by Apple under Apple's terms. Schools and districts may instead buy directly from us on a purchase order — see the refund policy for how that path works.
Refunds
Thirty days, no interrogation. The details are on therefund policy page.
Your data
The apps run on your machine and do not send us your work. What little information changes hands is described on theprivacy policy page.
What we promise, and what we do not
We build this software to be used in performance, and we take that seriously — it is the reason the apps work offline and keep running when the network does not. But no software is perfect, and we cannot promise it will be free of faults or will suit a particular purpose we have not described. The software is provided "as is".
To the extent the law allows, our total liability for any claim relating to the software is limited to what you paid for it. We are not liable for indirect or consequential losses. Nothing here limits liability that cannot lawfully be limited.
Said plainly: test your rig before you perform on it. That is true of every tool on a cart, ours included.
Ending a licence
You can stop using the software whenever you like. We may end a licence only if it is being redistributed or its key shared publicly, and we will contact you first. We do not revoke licences to force upgrades.
Changes to these terms
If these terms change, the date at the top changes and the new version applies to purchases made after it. We will not retroactively change the deal on a licence you already bought.
Governing law
These terms are governed by the laws of the State of Tennessee, USA.
